O R D E R

Heard the submissions made by the learned counsel appearing for the petitioner. Since this Court is not inclined to pass 1/4

any adverse order as against the respondent, notice to the respondent is dispensed with.

2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus to direct the respondent institution to disclose the result which was withheld in the year 2021 despite complying with the conditions of the institute by completing the Denovo Registration as insisted by the respondent.

3.The learned counsel appearing for the petitioner submitted that the petitioner joined the Institute of Cost Accountants of India in the year 2010 by paying fees of Rs.3,800/- in December, 2010 to the Foundation Course, which is the initial course of the above Institute. The petitioner attended the exam in December, 2010 and he scored 173 marks out of 400 marks and failed in the said exam and he reattempted the foundation course exam in June, 2011 and secured 179 marks and made third attempt in December, 2011 and the result was published on 01.02.2012 and he secured 208 marks out of 400 marks and passed in the said exam. Thereafter, the petitioner studied intermediate course and after several attempts, completed the same in December, 2014. Thereafter the petitioner applied for final course in 2/4

the year 2018 and after several attempts, again applied in the year 2020 and appeared for all the exams during December, 2020 and the said result was published in March, 2021 however, the exam status was shown as 'your result has been withheld for coaching / denovo / other reason.' In this regard, the petitioner approached the respondent several times, however, there is no response. Hence, this Court may direct the respondent institution to disclose the result which was withheld in the year 2021, by considering the petitioner's email dated 30.03.2021.

4.Considering the limited relief sought for in this petition, this Court, without expressing any opinion on the merits of the case, directs the respondent to consider the petitioner's email dated 30.03.2021, and disclose the reason for withholding the result of the petitioner so as to enable the petitioner to work out the remedy in the manner known to law, within a period of six weeks from the date of receipt of a copy of this order. The writ petition is disposed of. No costs.
