Respondents Petition under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the second respondent to transfer the petitioner from the present place of District Employment and Training Centre, Cuddalore, either to the District of Villupuram or to the District of Thiruvannamalai, by disposing the written representation made by the petitioner on 20.08.2015 within a stipulated period. ORDER
Mr.P.Manoharan has come to this Court seeking a mandamus to the second respondent to transfer him from the present place of employment at Cuddalore to Villupuram or Thiruvannamalai by disposing of his written representation. The ground adduced by the petitioner in the affidavit filed in support of the writ petition shows that his brother's son Mr.T.R.Ramachandran had fallen in love with one girl called Tamirabarani in the course of training and subsequently they got married at Madras and the marriage was also registered with the Sub Registrar office. Since the said marriage is an inter-caste one, there has been a https://hcservices.ecourts.gov.in/hcservices/
life threat to him on the ground that he was responsible for solemnising the marriage. Therefore, he has gone on medical leave from 14.3.2016 till now. In the meanwhile, he has also given a representation to the respondents seeking to transfer him to Villupuram or Thiruvannamalai.
As the said representation has not been considered, he has come to this Court.
2. Heard the learned counsel for the petitioner.
3. This Court does not find any merits in the writ petition. The reason is that the petitioner cannot unnecessarily make use of the marriage that took place between his brother's son and the girl Tamirabarani for disposal of his representation. Therefore, the writ petition fails and it is dismissed. Consequently, W.M.P.No.12073 of 2016 is also dismissed. No costs. ss s/d- Assistant Registrar(CO) True Copy Sub-Assistant Registrar To
