The petitioner/accused in Crime No.02 of 2024, registered by the respondent police for the offences under Sections 9(m) r/w 10 of POCSO Act, 2012 and 506 (i) of IPC by the respondent police and remanded to judicial custody on 23.01.2024, seeks bail.
2.The petitioner is married and has two daughters. The victim is aged 10 years old. It is stated that the petitioner had initially committed the offence on 16.12.2023 and a complaint was lodged and the petitioner was warned. Subsequently, again he had committed the same offence on 23.01.2024, leading to registration of FIR, on receipt of the complaint. 3.The learned counsel for the petitioner stated that the brother of the petitioner had given a complaint against the husband of the defacto complainant and therefore, out of motive, the present complaint had been lodged against the petitioner. But it must be seen that it is the victim child who is actually the victim and not either the defacto complainant or her husband or the brother of the petitioner.
