ORDER

The petitioner has challenged the impugned order dated 24.10.2025 passed by the respondent rejecting the petitioner's claim for compensation under the award passed under the Land Acquisition Act.

2.Since the Survey Number in the Sale Deed produced by the petitioner and the Survey Number of the land acquired by the respondent are different, the petitioner's request has been rejected under the impugned order since no additional document has been filed by the petitioner to prove that the petitioner is the owner of the subject property.

3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondent.

4.This Court, after hearing the submissions made by the learned counsel for the petitioner, expressed its view that since there are disputed questions of fact involved, necessarily the petitioner will have to approach the Civil Court and obtain declaratory decree in her favour that she is the owner of the property, to enable the petitioner to get the compensation amount from the respondent in respect of the land acquired by them, which the petitioner claims she is the owner.

5.Learned counsel for the petitioner, after this Court had expressed the aforesaid view, has now made an endorsement in the court bundle stating that the petitioner may be granted liberty to approach the Civil Court for the purpose of obtaining a declaratory decree that she is the absolute owner of the property and thereafter, approach the respondent for claiming the compensation amount.

6.In view of the endorsement made by the learned counsel for the petitioner in the court bundle, this writ petition is disposed of by granting liberty to the petitioner to approach the Civil Court by filing a Civil Suit for declaration that the petitioner is the absolute owner of the property and thereafter seek payment of the determined compensation amount from the respondent based on the said civil court decree. No costs.
