Prayer: Second Appeal filed under Section 100 of the Civil Procedure Code, against the judgment and decree dated 14.12.2011 made in A.S.No.11 of 2011 on the file of the Principal Subordinate Judge's Court, Tindivanam, confirming the judgment and decree dated 07.12.2010 made in O.S.No.102 of 2004, on the file of the Principal District Munsif Court, Tindivanam. J U D G M E N T

By order dated 05.10.2021, the instant second appeal has been referred to Mediation and after due deliberation there was an agreement among the parties. Therefore, in view of the terms of the mediation, the second appeal is to be disposed of. The terms of mediation agreement read as under:

(a) The appellant in second appeal will withdraw the second appeal No.431 of 2012;

(b) It is further agreed between the parties that they would sit for negotiation and thrash out all the differences among themselves and in the presence of village and panchayat all the parties to the suit will register the representative lands which they are in possession once the unambiguity is arrived among them;

(c) The entire process of setting right this issue will be completed within 30 days, the parties mutually agreed that both the appellant as well as respondent will not

go for any litigation pertaining to the present second appeal, the entire talks and agreement/negotiation was witnesses by Mr.Kuppan, S/o.Muthusamy vice president of Alagrammam Village Panchayat.

2. In the result, the second appeal is disposed of in terms of the mediation agreement dated 26.04.2022 and the mediation agreement shall form part of the decree. In the facts and circumstances of the case, there shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
