PRAYER : Transfer Civil Miscellaneous Petition filed under Section 24 of CPC, to withdraw the case in M.C.No.50 of 2021 from the file of the Family Court, Thirupur and transfer the same to the file of the Sub Court, Alandur, Chennai.

O R D E R

This transfer petition is filed to transfer MC.No.50 of 2021. After allowing the case for a considerable length of time, the learned counsel for the petitioner has chosen to withdraw the petition. However the fact remains that the M.C.No.50 of 2021 is now pending on the file of the Family Court, Tiruppur. Maintenance case cannot be kept pending for a prolonged period. In 1/4

the present case, the respondent is unemployed and taking note of the fact, the Family Court at Tiruppur is directed to dispose of the maintenance case in M.C.No.50 of 2021, within a period of three months from the date of receipt of a copy of this order. In respect of this transfer petition now filed by the petitioner, as per the request of the learned counsel for the petitioner, she is permitted to withdraw the transfer petition. No Costs. Consequently, connected miscellaneous petition is closed.
