CMP.NO.14011/2016 IN CMA.NO.SR.44808/2014 TRJ The petitioner/injured seeks to condone the delay of 528 days in re-presenting the appeal. As per Ex.P.2, Discharge summary issued by Padmapriya Hospital, Chennai, the injured was admitted on 30.7.2008 and was discharged on 3.8.2008. Ex.P.4 discharge summary issued by Sivasundar Hospital, Chennai also shows that the petitioner had underwent split skin grafting to cover the defect over the leg and skin of left foot. In view of the gravity of the injuries sustained, the petitioner was continuously taking treatment. Even the disability certificate, Ex.P.13 also shows that the suffered 13% disability, as a result, even after the award was passed, he was not able to cope up with the injury and pain. Therefore, this Court finds sufficiant cause for the delay in re-presenting the appeal. Accordingly, the delay is condoned.
