This application is taken out by the defendant to receive additional documents.

2. In the affidavit it is stating that the additional 39 documents are the online status of the trade mark application of the respondent, which are necessary to substantiate the case of the respondent.

3.The learned counsel for the respondent/plaintiff objects the application on the ground that these documents are all electronic documents but not accompanied by necessary certificate mandated under Section 65 B of the Indian Evidence Act.

4.On perusing of the documents, since these are public documents available in the public domain, this application is allowed subject to proof, relevancy and compliance of the mandatory requirements of Section 65 B of the Indian Evidence Act. Post the matter on 07.07.2021 for Case Management Hearing.
