Writ Petition filed Under Article 226 of the Constitution of India praying for issuance of Writ of Certiorarified Mandamus calling for the records of the 2nd respondent proceedings in RC.No.151/BC/2016 dated 14.03.2016 and quash the same and consequently direct the respondents to allot the available vacant C2 shed or any other shed in industrial estate at Virudhachalam, Cuddalore District.

O R D ER This Writ Petition has been filed by the petitioner to quash the 2nd respondent proceedings in RC.No.151/BC/2016 dated 14.03.2016 and consequently to direct the respondents to allot the available vacant C2 shed or any other shed in industrial estate at Virudhachalam, Cuddalore District.
2. When the matter is taken up for hearing today, none appeared for the petitioner. However, Mr.S.P.Prabhaharan, learned counsel appearing for the newly impleaded 4th respondent, would submit that as on date, no sheds are available in the said Industrial Estate. Initially, there were only 4 sheds available and the 4th respondent has invited applications for allotment of sheds through OnLine. Subsequently, 11 applications were received and out of 11 applications, 4 applications have been finalized and sheds were also allotted to them. Ironically, though the petitioner has filed this writ petition seeking for allotment of the vacant C2 shed or any other shed, he has not filed any application before the 4th respondent for the purpose of allotment. Since no sheds are available, he submits that the petitioner has not shown any interest in this regard.

Since all the sheds in the said Industrial Estate were already allotted to other persons and it appears that the petitioner has not shown any interest to file an application for the fresh allotment of sheds when applications were called for by 4th respondent. Thus, this would be the reason why the petitioner is not interested to prosecute the case any further. Hence, the present Writ Petition is dismissed for nonprosecution. No costs.
