This petition has been filed to modify the condition imposed by this Court in Crl.O.P.No.2398 of 2023 dated 06.02.2023 in para 6(a) as follows :- "6.(a) the petitioner is directed to deposit a sum of Rs.2,00,000/- (Rupees two lakhs only) to the credit of Crime No.29 of 2023 before the concerned Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order and shall produce the said receipt before the court below. "

The learned counsel for the petitioner submitted that he has already paid a sum of Rs.5,00,000/- to the vendor and since he is only a land broker, he unable to deposit a sum of Rs.2,00,000/- and he is ready to face the trial before the concerned Magistrate after executing sureties as per the order of this court. So, he finds difficult to comply the condition imposed by this court. Hence, the present petition has been filed to modify the condition.

Considering the facts and circumstances and also considering the reasons stated by the petitioner in the petition seems to be justifiable, this Court is inclined to modify the condition that the petitioner shall deposit a sum of Rs.50,000/- (Rupees fifty thousand only) to the credit of Crime No.29 of 2023 before the concerned Magistrate within a period of two weeks from the date of receipt of copy of this order and he shall produce the said receipt before the court below.

4. Except the above modification, the other conditions imposed by this Court in Crl.O.P. No. 2398 of 2023 vide order dated 06.02.2023 shall remain unalterted.

5. Time is extended for further period of two weeks for execution of sureties from the date of receipt of copy of this order. 08.06.2023 rpp 2/3
