Writ of Mandamus had been instituted to forbear the respondents 1 to 4 from interfering with the lands in Survey No.317/1A, T.S.No.1/128, Block 189, V.G.P. Selva Nagar 2nd Main Road, B.G.P. Selva Nagar, Velachery, Chennai - 600 042 and further direct the 5th respondent to grant planning permission as requested by the petitioner under Building Plan Application No.SD/WECN13/000258/2018 dated 24.05.2018.

2. The nature of relief as sought for in the present writ petition is not maintainable. The disputed fact of civil nature cannot be adjudicated since the issues are considered in the writ petition filed by the same writ petitioner in W.P.No.2616 of 2022. Therefore, no further adjudication needs to be entertained. In the event of institution of civil suit, the civil Court shall decide the issues independently based on the documents and evidences available on record, uninfluenced by the order passed in the writ petition.
