Respondents PRAYER : Petition filed under Section 397 & 401 of the Criminal Procedure Code, to set aside the order passed by the learned IV Metropolitan Magistrate at Saidapet, Chennai in C.M.P.No.4274 of 2017 dated 09.02.2018 by calling for the records and direct the second respondent being the Superintendent of Government Vigilance Home to hand over the victim girl under the custody of the petitioner.

The matter is heard through "Video Conference".

2. By the impugned order dated 09.02.2018, the petition for interim custody of the victim girl who was secured by the respondent police has registered a case in Crime No.124/17 for the offence under Sections 3(2)a, 4(1) and 5(1)(a) of IPT Act. Initially, she was given interim custody at Government Vigilance Home, Mylapore, Chennai.

3. The petitioner herein claims that the petition filed for custody. After observing the infirmities and contradictions of the facts, the learned Magistrate, dismissed the petition and ordered the victim girl to be detained in the Government https://hcservices.ecourts.gov.in/hcservices/

Protection home under Section 17(4) of Immoral Traffic Prevention Act, for a period of one year and the period is also over.
