..Respondents Writ petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of certiorarified Mandamus, calling for the records pertaining to the circular dated 28/11/2012 issued by the 2nd respondent and quash the same and consequently set aside the appointment of the 5th respondent in the post of Professor in Physics made with respect to

aforesaid circular, and further direct the 2nd respondent to appoint of the petitioner for the post of Professor in Physics ( with respect to advertisement published by the 2nd respondent in the New Indian Express & Dinamani on 28/11/2012 with Ref: Advt.No.N/1/2012) in the 2nd respondent college applying rule of roster reservation rectifying the error occurred in the selection process and further direct the 4th respondent to approve the appointment of petitioner for the aforesaid post of Professor in Physics from the date of appointment of the 5th respondent on the same method with protection of pay and service conditions.

ORDER

When the matter is taken up today, learned counsel for the petitioner reported that the petitioner expired pending the writ petition.

2. Recording the said submission made by the learned counsel for the petitioner and as no legal heirs have come forward to pursue the present writ petition, this writ petition is dismissed as abated. However, there shall be no order as to costs.
