IN THE HIGH COURT OF JUDICATURE AT MADRAS

DATED: 08.12.2021

CORAM:

THE HONOURABLE MR.JUSTICE R.SUBRAMANIAN CRP NO.2697 OF 2021 AND CMP NO.17678 OF 2021 D.Deepalakshmi @ Deepa Rep. by her Powr of Attorney Sumithra ... Petitioner (Cause title accepted vide common order dated 27.10.2021 made in CMP.17674 and 17678 of 2021 in CRP.SR.No.27935/2021) Vs Munusamy (died) 1.Ekambaram 2.R.Vasudevan 3.Jagadha 4.Kanniyammal ... Respondents Prayer:

Civil Revision Petition filed under Article 227 of the Constitution of India seeking speedy disposal of the Suit filed by the Petitioner herein in O.S.No.607 of 2008 on the file of the District Munsiff Court, Sriperumbudur, Kanchipuram District. For Petitioner : Mr.K.S.Kumar

O R D E R

The petitioner seeks early disposal of the suit in O.S.No.607 of 2008 on the file of the District Munsif, Sriperumbudur.

2.Considering the prayer sought for, notice to the respondent is deemed unnecessary.

3.The suit in O.S.No.607 of 2008 has been filed by the petitioner seeking specific performance of an agreement of sale dated 20.02.2005. The suit is pending for nearly 13 years now. https://hcservices.ecourts.gov.in/hcservices/

It is seen from the print outs from the e-Courts website that the suit is being adjourned on the ground of pendency of an application in I.A.No.102 of 2017 for nearly four years now. A copy of that application has been produced in the form of additional typed set. I find that it is an application by the plaintiff seeking permission to be represented by her power agent. It appears that the pendency is due to the non availability of Presiding Officer in the said Court for quite some time.

4.Taking into account, the fact that the suit is one for specific performance, the trial Court is directed to dispose of I.A.No.102 of 2017 within a period of two months from the date of receipt of a copy of this order in this revision and proceed to dispose of the suit within a period of eight months therefrom. The Civil Revision Petition is disposed of with the above directions. No costs. Consequently, the connected miscellaneous petition is closed.
