candidates which are to be filled up by non-Tamil medium candidates only and quash the same and direct the respondent to appoint the petitioner as Post Graduate Assistant (Physics).

This writ petition is filed seeking for Certiorarified Mandamus, to quash the advertisement No.03/2012 dated 28.2.2012 called for applications by the respondent for direct recruitment for the year 2011-2012 for the post of Post Graduate Assistants in the Tamil Nadu Higher Secondary Educational Service in the scale of pay of Rs.9300-34, 800 GP Rs.4800 so far it relates to the Direct Recruitment to the vacancies for the year 2011-2012 in the post of Post Graduate Assistant (Physics) reserved for Tamil medium candidates which are to be filled up by non-Tamil medium candidates only and direct the respondent to appoint the petitioner as Post Graduate Assistant (Physics). 2/5
2. There is no representation on behalf of the petitioner.
3. The learned standing counsel appearing for the respondent/Tamil Nadu Teachers Recruitment Board (TRB) has filed counter affidavit in December 2013. The relevant paragraphs are extracted hereunder for better appreciation and understanding:- " 4. It further submit that the petitioner states that she has completed her school education until high school with Tamil as medium of instruction. Further she obtained B.Sc. Physics degree in Tamil medium but she admits that she completed her post graduation M.Sc. Physics in English medium.
5. It is further submitted that as per the G.O.Ms.No.145 P&A Reform Department Dated 30.09.2010, candidate claiming preferential selection of studying in tamil medium should have studied the both their entire schooling, under-graduation and Post-graduation in tamil as their medium of instruction, even if they have did their schooling or even a single degree with English or other 3/5
language as their medium of instruction then it would render them ineligible for preferential selection in tamil medium.
6. I further submit that the petitioner was issued with a hall ticket and permitted to appear for the written examination for the selection of Post Graduate Teachers. She secured 73 marks in the written examination, the cut off fixed for Non-tamil candidates Physics in MBC category women was 101 hence she was not called for Certificate Verification as she did not got the eligible marks in written examination"
4. In view of the above factual matrix of this case, this writ petition stands dismissed. No costs. Consequently, connected miscellaneous petition is closed.
