This sub application is filed seeking to condone the delay of 322 days in representation of the Contempt Petition SR.No.35926 of 2024.

2. Heard both sides and perused the materials on record.

3. Not being satisfied with the reasons stated in the affidavit filed in support of the petition, this Court is not inclined to condone delay of 322 days in representation of the Contempt Petition SR.No.35926 of 2024.

4. It is also for the reason that as Section 5 of Limitation Act, 1963, has no application to initiate contempt proceeding, as held by the Hon'ble Apex Court in Om Prakash Jaiswal Vs. D.K.Mittal, reported in (2000) 3 SCC 171 and S.Tirupathi Rao, V. Lingamaiah, and Ors., reported in 2024 SCC Online 1764, the same analogy or principle would apply in relation to condoning the delay in representation also.
