ORDER

The criminal original petition has been filed to call for the entire records in pursuant to the FIR in Crime No.229/2023 on the file of the 1st respondent and quash the same.

2.When the matter was taken up for hearing today, the learned counsel for the petitioner submitted that trial Court by order dated 10.09.2024 in Crl.MP.No.2439 of 2024 did not take cognizance and closed the FIR in Crime No.229 of 2023. The learned counsel also produced a copy of order passed in Crl.MP.No.2439 of 2024, which is extracted hereunder. " Perused the materials available on records. It discloses that the complaint and the FIR were registered on the same day 13.10.2023 u/s. 12 TN Gaming Act, 1930 by the Respondent police. However, despite the expiry of the prescribed limitation period under section 468(2)(b) of the CrPC, the police have not yet filed a final report or an application for an extensiion of the limitation period with an explanation for the delay. Consdiering the trivial nature of the alleged offence and the absence of a satisfactory explanation for the delay, the court has decided not to take cognizance in this case and it is closed under section 468(2)(b) of the Cr.P.C. No property is remanded in this case."

3.Recording the abovesaid submission made by the learned counsel for the petitioner, this criminal original petition is disposed of. Consequently, connected miscellaneous petition is closed.
