This application has been filed to condone the delay of 359 days in filing the written statement of the 2nd defendant in C.S.No.392 of 2020. 2.Heard the learned counsel for the applicant and the learned counsel for the respondents and also perused the materials available on record.

3.The learned counsel for the applicant submitted that due to COVID-19 pandemic situation there was a delay in filing the written statement.

4. The learned counsel for the respondents have no serious objection for allowing this application.

5.On being satisfied with the averments stated in the affidavit filed in support of the application and also considering the submissions made by the learned counsel on either side, the delay is condoned. Page No.1/3

6.Since the 2nd defendant has already filed written statement along with this application, the Registry is directed to receive the written statement, if it is otherwise in order and place it on record and post the suit ''for framing issues'' on 12.04.2022.

7. In the meantime, both the parties are directed to file their draft issues, if they choose.
