PRAYER: Civil Revision Petition filed under Article 227 of Constitution of India, to issue direction directing the learned VII Assistant Judge, City Civil Court, Chennai to dispose of the suit in O.S.No.6992 of 2014 within a time frame. For Petitioner : Mr.Arulappa Prem Kumar

O R D E R

The limited prayer sought for in this petition is for a direction to the trial Court to dispose of the proceedings in O.S.No.6992 of 2014, within the stipulated period.

2. The petitioner herein has originally filed a suit in O.S.No.6992 of 2014, on the file of the learned VII Assistant Judge, City Civil Court, Chennai for a declaration to declare that the termination letter issued by the defendant by terminating the plaintiff from the service of Regional Manager, South Chennai from the defendant company dated 07.11.2014 as null and void and for a mandatory injunction directing the defendant to reinstate the plaintiff as Regional Manager, South Chennai in the original position of the defendant's company. The suit was filed in the year 2014 and the same is being contested by the respondent.

3. Heard the learned counsel for the petitioner and perused the materials placed before this Court.

4. On a perusal of the adjudication orders, it is seen that originally the suit has been filed in the year 2014 and the https://hcservices.ecourts.gov.in/hcservices/

counter has been filed in the year 2019. This matter has been adjourned very many times for the cross examination of D.W.1, till date. The whole nation has been facing the difficult situation of lock down for the past one year. Due to the nation wide lock down, the Court below did not proceed further in this matter.

5. Hence, it would be appropriate to direct the learned VII Assistant Judge, City Civil Court, to conduct trial in O.S.No.6992 of 2014 on a day to day basis and to dispose of the same, within a period of four months from the date of receipt of copy of this order. The trial Court should not give any further adjournment with regard to the cross examination of D.W.1.

6. Accordingly, the Civil Revision Petition stands disposed of. No costs.
