ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 294(b), 323 and 506(i) of IPC in Crime No. 51 of 2022, on the file of the respondent police, seeks anticipatory bail.

2. The petitioner herein is the bar owner and he has gone to the TASMAC out-let and demanded 50 bottles of 375 ml Old Chef brandy, which the Salesman has refused to give because the petitioner asked the liquor in bulk to sell it during the prohibited hours, hence the quarrel has occured. The Salesman Ganesan was attacked by the petitioner and four others. However to get over the same, the petitioner himself has taken the said Ganesan to the police station and given a false complaint with these allegations. The FIR has been registered on 03.03.2022 by the respondent police. Apprehending arrest in this case, the petitioner is before this Court. https://hcservices.ecourts.gov.in/hcservices/

The learned Government Advocate (Crl.side) submits that the investigation conducted so far indicates that this petitioner along with four others have gone to the TASMAC shop and demanded liquor in bulk for selling it in his bar during night hours, which is prohibited. In this altercation one Ganesan was seriously injured and the Supervisor of the shop has given a complaint and the same is under investigation. The petitioner and others are absconding after giving oral complaint at police station about this occurrence unless they are secured the investigation will not be completed, hence their abscondence is hindering investigation.
