Cuddalore Region No.2, Imperial Road Cuddalore - 2 Respondents Writ Petition filed under Article 226 of the Constitution of India seeking a writ of certiorarified mandamus calling for the records pertaining to the order in Letter No.117/L6/MCOP/TNSTC/Cuddalore Region/16 dated 22.03.2018 passed by the second respondent, quash the same and consequently, direct the respondents to provide the petitioner forthwith suitable alternative employment/light office/desk work with pay protection, continuity of service, backwages and other service benefits with effect from 01.03.2006, after adjusting the salary paid to the petitioner during the intermittent spells during which he was temporarily given various light work.

ORDER

This writ petition has been filed impugning the order dated 22.03.2018 passed by the second respondent, in and by which, the petitioner has been refused alternative job.

A counter affidavit has been filed on behalf of the respondents, wherein, it is stated that during the pendency of this writ petition, the sole writ petition died on 01.07.2018 and after his demise, his legal heirs have received service benefits to the tune of Rs.6,77,352/- vide cheques dated 15.04.2019 and 31.08.2019. It is further stated in the counter affidavit that the petitioner's legal heirs are receiving a monthly pension of Rs.12,505/-. The learned counsel for the petitioner also endorses that the petitioner died on 01.07.2018 and the petitioner's legal heirs have received the service benefits and monthly pension is being paid to them. In view of the above factual position, in my considered view, no 2/4

further adjudication is required in this writ petition. Accordingly, this writ petition is dismissed as having become infructuous. Costs made easy.
