Today, the matter is listed under the caption "for being mentioned" at the instance of the learned counsel for the petitioners.

2. This Court, by an order dated 27.10.2022, dismissed the Revision Case filed as against the order passed by the II Additional District and Sessions Judge, Tiruppur in C.A.No.47 of 2016 dated 16.12.2016, thereby confirming the conviction and sentence passed by the Judicial Magistrate (Fast Track Court, Tiruppur) in S.T.C.No.136 of 2012 dated 26.11.2015.

3. The learned counsel for the petitioners would submit that after dismissal of the revision case, the petitioners had settled the entire cheque amount to the respondent and also entered into a compromise between them. At the time of suspending the sentence, this Court imposed condition to deposit a sum of Rs.50,000/- to the credit of S.T.C.No.136 of 2012. After compromise, the respondent filed a petition to refund the deposited amount. However, it was returned, since the matter has been settled between the parties. The petitioners also had no objection to return the money to the respondent.

4. Considering the above submission, the Trial Court is directed to permit the respondent to withdraw the amount deposited by the petitioners in the credit of S.T.C.No.136 of 2012.

5. Accordingly, Crl.R.C.No.409 of 2018 is clarified. Registry is directed to carry out the necessary correction and issue a fresh order copy.
