... Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondent Assistant Commissioner of Labour, Krishnagiri to record the conciliation failure with

regard to the Industrial Dispute raised by the petitioner union on 16.08.2017 bearing reference No.NA.KA. No. A/503/2017 and forward the report to the 1st respondent Government of Tamil Nadu and further direct the 1st respondent to pass orders with regard to the reference of the above Industrial Dispute under Section 10 of the Industrial Dispute Act with in such stipulated time.

O R D E R

The relief sought for in this writ petition is to direct the respondent Assistant Commissioner of Labour, Krishnagiri to record the conciliation failure and send a report to the concerned authorities for passing appropriate orders.

2. The learned counsel for the writ petitioner now made a representation that the conciliation officer had quashed the proceedings and submitted a report to the Government. Thus, it is for the Government to consider the report and pass appropriate orders in respect of the demands raised by the Registered unions.

3. In this regard, the first respondent is directed to consider the report, take a decision and pass appropriate orders within a period of twelve(12) weeks from the date of receipt of copy of this order.

4. Accordingly, the writ petition is disposed of. Consequently, the connected Miscellaneous petition is closed. No costs.
