ORDER

The petitioner, who was arrested and remanded to judicial custody on 04.02.2026 for the alleged offence punishable under Sections 296(b), 109(1) and 351(3) of BNS, 2023 in Crime No.48 of 2026, registered on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he is the brother of one of the accused in a previous case concerning the throwing of a petrol bomb. Due to the said enmity, the petitioner went to the shop of the defacto complainant, threatened him, and instructed him to withdraw the case. Further, the petitioner attacked the defacto complainant with knife, causing injuries. Hence, a case has been registered and the petitioner was arrested.

3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent, and has been falsely implicated, due to previous enmity and that he is in judicial custody since 04.02.2026. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is having four previous cases under Section 379 IPC and POCSO offences. He further submitted that the injury in this case has been discharged from the hospital on 07.02.2026. Hence, he opposed to grant bail to the petitioner.

5. Considering the fact that the petitioner attacked the defacto complainant with the intention of threatening him to withdraw the complaint lodged against his brother and caused grievous injuries, and the fact that the petitioner has four previous cases pending against him, this Court is not 2/4

inclined to grant bail to the petitioner.
