APPLICATION NO.4337 of 2016 IN C.S.NO.544 of 2010 PUSHPA SATHYANARAYANA, J The above application is filed to strike out the pleadings in the amended plaint in C.S.No.544 of 2010 and return the amended plaint to the plaintiffs to carry out the amendment in consonance with the original plaint. 2.

There was an amendment, which was carried out in the amended plaint, factually seems to have certain additions, which were objected to by the defendants' counsel.

However, learned counsel for the plaintiffs pointed out that it was by mistake, the amended copy of the plaint in Diary No.3949 of 2015 was filed. Therefore, he is not pressing the said copy and he has also filed another amended plaint in Diary No.32494 of 2016, which should be taken on file.

The learned counsel for the defendants has got no objection in receiving the amended plaint copy in Diary No.32494 of 2016. 5.
