ORDER
The above writ petition is filed seeking a mandamus to the respondents to disburse the leave encashment benefits to the petitioner which the petitioner entitled for the periods of February 2019 and February 2020 with interest at the rate of 9% per annum from the said date of entitlement till the date of actual disbursement.
2. It is an admitted fact that the petitioner, who had joined the services of the respondent corporation, had retired from service on 31.07.2023. The petitioner would submit that though he had retired from service on 31.07.2023, the leave encashment benefits to which he is entitled for the periods February 2019 i.e., Rs.25,852/- and February 2020 i.e., Rs.29,314/- has not been paid to him. Therefore, 2/5
the petitioner made a representation to the respondents to pay the said amounts with interest. However, the respondents have not taken any steps whatsoever to consider the petitioner's representation dated 01.12.2025. Therefore, the petitioner has approached this Court.
3. Heard the learned counsels on either side and perused the materials available on record.
4. Considering the above facts and circumstances of the case, a mandamus is issued to the respondents to pay the leave encashment benefits to the petitioner which he entitled for the periods February 2019 i.e., Rs.25,852/- and February 2020 i.e., Rs.29,314/- with interest @ 6% p.a for the belated payment, within a period of six weeks from the date of receipt of a copy of this order taking into account the bank rate of interest on deposits. Accordingly, this writ petition is disposed of. No costs.
