Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition imposed on the petitioner by this Honble Court vide order dated 05.06.2017 passed in Cr.M.P.No.6788 of 2017 in Crl.Appeal No.283 of 2017 to appear before the Trail Court on the 1st working day of every month, pending disposal of the CRL.A.No.283 of 2017 Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of MR.MURALI KUMAR for M/S.MCGAN LAW FIRM, Advocate for the petitioner, and of MR.K.PRABAKAR Additional Public Prosecutor (V&AC) on behalf of the Respondent, the court made the following order:- The petition has been filed to relax the condition imposed on the petitioner in Crl.MP.No.6788 of 2017 dated 05.06.
2017 to appear before the Special Judge/X Additional Judge, Chennai, on the 1st working day of every month at 10.30 am., until further orders. 2.The learned counsel for the petitioner would submit that he has been granted suspension of sentence by order dated 05.06.2017 in Crl.MP.No.6788 of 2017, with a condition to appear before the Special Judge/X Additional Judge, Chennai, on the 1st working day of every month at 10.30 am., until further orders.
petitioner has been regularly complying with the conditions by appearing before the trial Court on the 1st working day of every month. He would further submit that the petitioner is aged about 87 years and that he is a known case of diabetes with complaints of infected wound and that he has also undergone right tibial angioplasty on 23.02.2019 and he has been advised to take complete bed rest. He would further submit that due to the surgery undergone, the petitioner may not be able to appear before the Court on the 1st working day i.e., on 01.03.2019 and he would seek modification/relaxation of condition.
3.The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner has been regularly complying the condition from 05.06.2017.
4.In view of the submissions, the condition is modified to the effect that the petitioner shall appear before the Special Judge/X Additional Judge, Chennai, once in three months on the 1st working day of the particular English calender month (starting from June 2019). 5.With this direction, the Criminal Miscellaneous Petition is ordered.
