This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 26.04.2024, seeking bail in Crime 1/4

No.112 of 2024 registered for the offences under Sections 8(c), 22(c) & 29(1) of NDPS Act.

2. The case of the prosecution is that the respondent police found the accused persons in illegal possession of 1920 Nitrovet tablets. Hence the case.

3. The learned counsel appearing for the petitioner submitted that the allegations against the petitioner are false; that no contraband was recovered from this petitioner; that he has been implicated based on the confession of the coaccused and that in any case, considering the period of incarceration of the petitioner, further custody of the petitioner is not required and hence prayed for grant of bail.

4. Learned Government Advocate (Crl.Side) appearing for the respondent police, reiterated the prosecution case and on instructions, submitted that the petitioner has 22 previous cases.

5. The earlier bail application was dismissed by the Hon'ble Mrs Justice T.V.Thamilselvi by making following observations: 2/4

"5. Considering the fact of the case, the contraband seized from the petitioner is commercial quantity. On seeing the gravity of the offence, this Court is not inclined to allow this petition. Accordingly, the petition is dismissed". This Court finds that there is no change in circumstances. Therefore, this Court is not inclined to grant bail to the petitioner at this stage.
