S.A.No.502 of 2012 S.A.No.502 of 2012 C.KUMARAPPAN, J., This Court admitted the Second Appeal after hearing the learned counsel for the appellant and formulated the following substantial questions of law:

(i) Whether a mere suit for permanent injunction is maintainable in law without a prayer for declaration of the plaintiff's alleged right to the site of the suit property? (ii) In the absence of any lease deed between the title paramount and original tenant empowering him to alienate the lease hold rights, whether the plaintiff can claim any relief on the basis of the said transfer? (iii) Whether the suit for permanent injunction is maintainable when the defendant has been recognized as a tenant by the title paramount?
