made in Na.Ka.No.Aa3/7394/2020 dated 06.10.2022 of the 2nd Respondent herein and release the compensation amount to the Petitioner as per the Will dated 31.01.2025, registered as Document No.1 at the Sub Registrar Office, Avarapakkam by considering the Petitioner's representation dated 02.01.2026 to the 5th Respondent.

ORDER

This writ petition has been filed to direct the fifth respondent to fix the compensation amount for the land, morefully disclosed in the prayer to this writ petition and release the compensation amount to the petitioner, based on the petitioner's representation dated 02.01.2026, within a time frame to be fixed by this Court.

2.The petitioner claims that he alone was the owner of the property, morefully disclosed in the prayer to this writ petition, based on a Will executed by his father dated 31.01.2025. The petitioner claims that till date, the compensation amount has not been paid by the respondents. The petitioner therefore had given a representation on 02.01.2026 to the fifth respondent seeking for payment of compensation for the acquired land. Since the said representation was not considered, the petitioner has filed this writ petition.

3.Mr.M.R.Gokul Krishnan, learned Additional Government Pleader, who accepts notice on behalf of the respondents, on instructions, would submit that there is a dispute with regard to the title of the property between the petitioner and his brother. He would submit that the representation of the petitioner, as stated supra, will be considered by the respondents, on merits and in accordance with law, within a time frame to be fixed by this Court. 4.No prejudice would be caused to the respondents if the petitioner's representation is directed to be considered, on merits and in accordance with law, after hearing all the necessary parties, which includes any rival claimant. 5.

For the foregoing reasons, this writ petition is disposed of by directing the fifth respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 02.01.2026 seeking for determination of the compensation amount payable for the land acquired from the petitioner, morefully disclosed in the prayer to this writ petition and for releasing the said payment to the petitioner, based on the registered Will dated 31.01.2025, after hearing all the necessary parties, which includes any rival claimant, within a period of 12 weeks from the date of receipt of a copy of this order. No costs.
