Rules read with Order VII Rule 1 of the Civil Procedure Code praying for a judgment and decree for settling a scheme for the administration of the 1st defendant Trust:- a) by removing defendants 2 to 5 from the office of Trustee; b) by appointing new Trustees from among the trustees apart from 1/4

defendants 2 to 5 and public spirited persons and donors interested in the welfare of the trust.

c) to require the trustees/defendants 2 t 5 herein, to submit accounts of income and expenditure incurred till the date of the suit; d) to cause enquiries into the accounts and affairs of the Trust ; e) to direct defendants 2 to 5 to return the amounts defrauded from the 1st defendant trust;

f) for costs of the suit.

J U D G M E N T

When the matter is taken up for hearing, the learned counsel appearing for the plaintiffs has filed a memo stating that the plaintiffs, due to their age and ailment issues, are not interested in continuing the suit and proceeding further and hence, he seeks permission of this Court to withdraw the Suit .

3. Recording the memo filed by the learned counsel for the plaintiffs, this Civil Suit is dismissed as withdrawn. Consequently, the connected application is closed. No costs.
