These petitions have been filed (i) to condone the delay of 14 days in filing the petition to set aside the abatement caused by the death of the first respondent, (ii) to set aside the abatement caused by the death of the first respondent and (iii) to bring on record the legal representatives of the deceased first respondent.

2. Being satisfied with the reasons stated in the affidavits filed in support of the above petitions, these Civil Miscellaneous Petitions are allowed.

3. Issue notice to the proposed Respondents 4 to 8 returnable by 01.12.2023.

4. Post the matter under the caption "finally" on 01.12.2023. 16.11.2023 mkn2 Note : Registry is directed to carry out necessary amendments in the cause title in the Second Appeal.
