ORDER
This petition has been filed seeking a direction to the respondent to consider and dispose of the Petitioners representation dated 21.01.2026 within a time stipulated time frame, and to direct the respondent to correct the petitioner's date of confirmation in service as 2002 being the year in which the petitioner completed 240 days of continuous qualifying service, and also to direct the respondent to grant all consequential service and monetary benefits including correct pay fixation, seniority arrears and attendant benefits. 2.The case of the petitioner is that he was appointed as a Daily Wage Conductor in the respondent Corporation in 1998, through Employment Exchange and has rendered uninterrupted service. However, his confirmation has been wrongly recorded only from 2005, resulting in loss of seniority and monetary benefits. The issue stands covered by the judgement of this Court dated 29.01.2018 in W.P No.31831 of 2012 (Magesh & others), wherein it was held that the recruitment ban orders cannot be relied upon to deny confirmation
to existing employees. Despite submitting a representation dated 21.01.2026, no order have been passed. Hence the present writ petition has been filed. 3.The learned counsel for the petitioner would submit that it would suffice, if a direction is issued to the 1st respondent to consider the petitioner's representation within a reasonable time.
4.The learned Standing Counsel appearing for the 1st respondent would submit that they will consider the petitioner's representation and pass appropriate orders within a reasonable time to be fixed by this Court. 5.Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the 1st respondent to consider the petitioner's representation dated 21.01.2026 on and to pass appropriate orders on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order,
6.With the above directions, this writ petition is disposed of. No costs. 25-02-2026 Index: Yes/No Speaking/Non-speaking order UMA To The Managing Director Metropolitan Transport Corporation (Chennai) Limited, No.2, Pallavan Salai, Chennai.
