O R D E R

Heard Mr.K.C.Karl Marx, learned counsel for the petitioner and Mr.R.A.S.Senthilvel, learned Additional Government Pleader for the respondent.

2. The petitioner has filed this writ petition to direct the respondent to give pistol licence to the petitioner for his personal security by considering his application dated 02.03.2012.

3. It is seen that the respondent was not inclined to consider the petitioner's request on the ground that the Superintendent of Police, Nagapattinam, has, in his report dated 29.05.2012 addressed to the respondent stated that a criminal case is pending against the petitioner.

4. The petitioner would state that the said criminal complaint was investigated, charge sheet was filed and the same was taken on file in S.C.No.17 of 2013 on the file of learned Assistant Sessions Judge, Nagapattinam and the petitioner, who was arrayed as A3, has been acquitted by judgment dated 16.05.2013. Thereafter, the petitioner once again requested the authorities to consider his https://hcservices.ecourts.gov.in/hcservices/

request. In this regard, the petitioner's application has been forwarded to Tahsildar, Nagapattinam by the Revenue Divisional Officer, Nagapattinam, for offering specific remarks. Therefore, the application is now pending before the authorities for furnishing remarks.

In the light of the above, there shall be a direction to the Revenue Divisional Officer, Nagapattinam, to call for appropriate report from the Tahsildar, Nagapattinam, as called for in his letter dated 15.06.2014 and submit the same before the District Collector, Nagapattinam for being considered on merits. The Revenue Divisional Officer, Nagapattinam, is directed to comply with the above direction within a period of four months from the date of receipt of a copy of this order.

6. This Writ Petition is disposed of with the above direction. No costs.

Since, the Revenue Divisional Officer, Nagapattinam, is not a party to this Writ Petition, Registry is directed to forward a copy of this order to the Revenue Divisional Officer, Nagapattinam.
