ORDER
This petition has been filed seeking a direction to the respondents 1 to 3 to pay the interest amount of Rs.8,87,848.72 in delayed payment of gratuity and earned leave salary in accordance with the orders of the Hon'ble High Court of Madras and the applicable Pension Rules.
2.The case of the petitioner is that he was employed as Secretary in the 3rd respondent Society and retired on superannuation on 31.05.2017. However, his retirement benefits were not disbursed. He filed a revision petition before the 2nd respondent in 2018, which was allowed on 27.09.2021. Though the gratuity amount of Rs.7,92,730/- had already been transferred by the Life Insurance Corporation of India, Vellore, to the Vettavalam Central Cooperative Bank
Branch on 25.07.2017 itself, it was not paid to him. Hence, he filed W.P No.18619 of 2022, and by order dated 21.07.2022, this Court directed the 1st respondent to ensure the release of his retirement benefits. As the order was not complied with, the petitioner filed Cont.P No.2243 of 2023. By oider dated 12.04.2024, this Court directed payment of interest at 12% per annum fro the delayed payment. Subsequently, the petitioner sent a representation dated 02.01.2026 seeking payment of Rs.8,87,848.72 towards interest for the delayed disbursement of gratuity and earned leave salary. However, the same has not been considered till date. Hence the present writ petition has been filed. 3.
The learned counsel for the petitioner would submit that it would suffice, if a direction is issued to the respondents 1 to 3 to consider the petitioner's representation within a reasonable time. 4.Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the respondents 1 to 3 to consider the petitioner's representation dated 02.01.
