Prayer: Writ Petition is filed under Section 226 of the Constitution of India for issue of Writ of Mandamus, directing the respondents to pay interest of 12% to the petitioners for belated payment of Gratuity, Leaye Salary, Provident Fund and commutation of pension amounts within a time frame to be fixed by this Court. O R D E R

This writ petition is filed for the following relief: "To direct the respondents to pay interest of 12% to the petitioners for belated payment of Gratuity, Leaye Salary, Provident Fund and commutation of pension amounts within a time frame to be fixed by this Court."

2. Heard the learned counsels appearing on either side. With the consent of both sides, the Writ Petition is taken up for hearing at the admission stage itself.

3. It is the case of the petitioners that they joined the service of the first respondent Corporation and retired from service during the years 2018 - 2024. However, the terminal benefits have been settled only after 6 to 25 months. Therefore, the petitioners sent a representations which evoked no response so far. Hence, the present Writ Petition has been filed claiming 12% interest for the belated payment of retirement benefits such as Gratuity Leave salary, Provident fund and commutation of pension amounts.

4. The learned counsel for the petitioners submitted that it would be suffice if this Court issues a direction to the respondents to consider the petitioners' representation and pass orders.

5. The learned Standing Counsel appearing for the respondents submitted that the representation of the petitioner will be considered and will pay the eligible amount with 6 % interest P.A as per the earlier orders of this Court.

Considering the facts and circumstances of the case and the submissions made by either side counsel, this Court directs the Respondent/Corporation to consider the petitioners' eligibility to the amounts payable to them and thereafter pay the same along with interest at the rate of 6% per annum for the delay period in settling the said amount. This payment shall be made within a period of eight weeks from the date of receipt of a copy of this order. It is made clear that if the amount is not paid within the time frame fixed by this Court, it will fetch an interest at the rate of 12% per annum from the date on which the amount became due and payable till the date of actual disbursement.

7. With the above directions, this Writ Petition stands disposed of. Consequently, the connected miscellaneous petition is closed. No costs.
