ORDER
Transfer Petition filed praying to withdraw O.S. No. 39 of 2025 from the file of the Family Court, Erode District, and transfer the same to the file of the Family Court, Tiruchirapalli District.
2. The learned counsel for the petitioner submits that the petitioner seeks transfer of the case from the Family Court, Erode, to Tiruchirapalli, where she is residing with her two minor children. She further submits that, as on date, the respondent/husband has neither paid any maintenance nor taken care of the family. Therefore, she is facing hardship in maintaining the two children and is unable to attend the court proceedings at Erode.
3. The learned counsel appearing for the respondent raised objections, contending that the respondent/husband intends to see the children, but the petitioner has refused to permit visitation rights. She further submitted that disputes between the parties had earlier resulted in police complaints and, therefore, the respondent is apprehensive about attending court proceedings at Erode. It is also submitted that the respondent is a dental doctor by profession and is practising at Trichy. Admittedly, the petitioner is also a doctor by profession.
4. Considering the convenience of both parties, this Court is inclined to transfer the case to the Sub Court, Karur. Both parties, being doctors by profession, are permitted to appear through video conferencing, except on such dates when the Court specifically requires their personal appearance.
5. Further, considering that the petitioner is residing with two minor children, the respondent/husband is directed to pay a sum of Rs.15,000/- towards interim maintenance for the children until any modification is made by the competent Court. The petitioner/wife is also directed to comply with the visitation rights granted to the respondent/husband to meet the children, in terms of the earlier order passed by the Court.
6. With the above observations, this Transfer Petition stands disposed of. No costs. Consequently, the connected miscellaneous petition is closed. 15-06-2026 Index: Yes/No Speaking/Non-speaking order MPA To
