A.No.4352 of 2016 in C.S.No.17 of 2006 PUSHPA SATHYANARAYANA, J Application No.2279 of 2016 was filed for condoning the delay of 1100 days in setting aside the ex-parte decree and the same was condoned on 19.07.2016 on terms, which were also complied with. However, the plaintiff had taken the same on appeal, which was dismissed.

2. The present application No.4352 of 2016 is filed to set aside the ex-parte decree dated 12.02.2008 on the same grounds, the delay was condoned.

3. This Court is satisfied with the reasons for setting aside the exparte decree dated 12.02.2008 and accordingly application is allowed and the ex-parte decree dated 12.02.2008 is set aside. 09.09.2016 srn
