..Respondents Prayer: The Writ Petitions are filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the respondents to issue machinery working condition certificate to the petitioner to participate in the tender viz., TENDER NOTICE REFERENCE No.DIPR/4411/TENDER/2017, dated 27.10.2017 for Salem, Yercaud, Ayyothiyapattnam, Machari and Attur Blocks as per the application of the petitioner dated 29.11.2017. For Petitioner : Mr.S.Doraisamy For Respondents : Mr.S.Diwakar, Spl.G.P.

O R D E R

The petitioner has filed this petition to direct the respondents to issue machinery working condition certificate to the petitioner to participate in the tender viz., TENDER NOTICE REFERENCE No.DIPR/4411/TENDER/2017, dated 27.10.2017 for Salem, Yercaud, Ayyothiyapattnam, Machari and Attur Blocks as per the application of the petitioner dated 29.11.2017 https://hcservices.ecourts.gov.in/hcservices/

2. When the matter is taken up, it is represented by the learned Special Government Pleader appearing for the respondent that without prejudice to the other conditions including the tender conditions, the petitioner may be directed to furnish his declaration with regard to the machinery conditions and the petitioner's request will be considered subject to the verification of the machinery working conditions.

3. As the online submission of the tender is upto 3.00 pm on 04.12.2017 and online opening of bid is at 4 p.m. on the same day, the respondents submitted they are willing to accept the submission of tender, even without the order copy of this writ petition.

In the view of the above, the writ petition is disposed of. No costs.
