Respondents PRAYER: Criminal Original Petition is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, to transfer the investigation in Crime No.264 of 2024 pending on the file of the Sub Inspector of Police, Thittagudi Police Station, Cuddalore District, to any other officer to conduct further investigation into the matter in accordance with law. O R D E R
This Criminal Original Petition has been filed for the transfer of the investigation in Crime No.264 of 2024 from the file of the second respondent to any other investigating agency.
2. The learned Government Advocate (Crl.Side) appearing for the respondents submitted that based on the complaint lodged by the petitioner, an FIR has been registered in Crime No.264 of 2024 for the offences under Sections 329(1), 305 and 351(2) of the Bharatiya Nyaya Sanhita, 2023. After registering the FIR, the entire investigation has been completed and final report was filed. He further submitted that if the transfer of investigation is ordered at this stage, it would affect the entire investigation done by the second respondent.
3. In view of the above, this Court is not inclined to transfer the investigation in Crime No.264 of 2024 on the file of the second respondent. However, the second respondent is directed to complete the investigation and file a final report within a period of eight (8) weeks from the date of receipt of a copy of this order.
4. With the above direction, this Criminal Original Petition stands disposed of.
