ORDER

The petitioners, who were arrested and remanded to judicial custody on 22.01.2026 for the alleged offence punishable under Section 304(2) of BNS, in Crime No.44 of 2026, registered on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he waylaid the defacto complainant and snatched away his mobile phone. Hence, a case has been registered and the petitioner was arrested.

3. The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated, on account of previous cases against them. He further submitted that they are in judicial custody since 22.01.2026 and that he is ready to co-operate with the investigation. Hence, he prayed to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the first petitioner has two previous cases and the second petitioner has three previous cases pending against them. He further submitted that the stolen property has not yet been recovered and that the investigation is still pending. Hence, he opposed to grant bail to the petitioners.

5. Considering the nature of the allegations and the fact that the petitioners have bad antecedents and that the stolen property has not yet been recovered, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 20.02.2026 drl 2/4
