PRAYER: This criminal miscellaneous petition has been filed under Section 528 of BNSS Act, to modify the condition imposed in Crl.O.P.No.3731 of 2025 dated 14.02.2025 in para no.7 the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties, each for a like sum to the satisfaction of the learned I Additional Subordinate Judge, Salem.

ORDER

The petitioner seeks modification on the condition that he is directed to execute a bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties imposed by this Court in Crl.O.P.No.3731 of 2025 dated 14.02.2025.

2. The learned counsel for the petitioner submitted that the petitioner is very poor and cannot produce two sureties for a sum of Rs.50,000/- and further submitted that the petitioner was arrested on 04.11.2024 pursuant to the NBW warrant issued by the learned trial Judge on 14.08.2024.

3. Heard the learned Government Advocate (Crl.Side) for the respondent.

4. Considering the aforesaid facts, this Court is of the view that the condition can be modified as follows:

7..the petitioner is ordered to be released on bail on condition of executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the learned I Additional Subordinate Judge, Salem.

The other conditions imposed in the order dated 14.02.2025 in Crl.O.P.No.3731 of 2025 shall remain unaltered.

5. Further, time to furnish surety is extended by a period of two weeks from the date of receipt of a copy of this order.

6. Accordingly, the criminal miscellaneous petition is ordered, and the condition is modified.
