Order (Order of the Court was made by S.M.Subramaniam J.) The review petitioner herein preferred a writ petition seeking a direction to the Government to take into account, the period of maternity leave availed by her as service for promotion to the post of Assistant Section Officer by including her name in the panel year 2009-2010 and fix the seniority in the appropriate place at 50A of the seniority list released on 11.11.2016.
2. The Division Bench of this Court in the intra-Court appeal filed by the Secretary to Government, P & AR Department, elaborately considered, including the number of days of leave availed by the review petitioner. When the leave period was taken into consideration and the consequences of long leave during the probation period was also taken into consideration by the Division Bench, there is no scope of entertaining the review petition on those factual ground as raised by the review petitioner herein.
3. In paragraph No.13 of the judgment sought to be reviewed, the Division Bench has considered the fact regarding the availing of long leave by the review petitioner during the probation period and that being the factum, readjudication on merits in the present review petition is inadmissible.
4. Learned counsel for the petitioner made an attempt to raise grounds on merits which would fact beyond the scope of review petition and that being
the factum, the present review petition is devoid of merits and the petitioner has not established any error apparent on the face of record. Consequently, Review Application stands dismissed. No costs. Connected miscellaneous petitions are closed.
