O R D E R

The petitioner-wife has filed the above Tr.C.M.P seeking to withdraw and transfer the G.W.O.P.No.99 of 2021 from the file of the 1/4

Principal District Court at Vellore to the file of the Principal Court, City Civil Court, Chennai.

2. The petitioner-wife had filed H.M.O.P.No.102 of 2015 on the file of the Sub Court, Gudiyatham in which, an ex-parte order was passed on 20.06.2016. The respondent-husband had not preferred any appeal against the said order and the same has attained finality. Thereafter, in the year 2021, she got married with one Shankar and is living with him along with her son. Meanwhile, the respondenthusband had filed G.W.O.P.No.99 of 2021 before the Principal District Judge, Vellore and the same is pending for trial. This Court, vide order dated 07.11.2024 in C.R.P(PD) No.4450 of 2024, had granted the visitation rights to the respondent-husband.

3. The petitioner-wife is residing with her husband, Shankar along with her son, who is studying in VIII Standard at Sri Vani Vidyalaya Matric Higher Secondary School, Chengalpet. She finds it very difficult to travel over 10 hours, both ways from Chennai to 2/4

Vellore for each and every hearing of the case. Hence, she sought for transfer.

Considering the fact that the residence of the minor falls within the jurisdiction of the District Court, Chengalpet, the G.W.O.P.No.99 of 2021 pending on the file of the Principal District Court, Vellore is withdrawn and transferred to the file of the District Court, Chengalpet. Accordingly, this Transfer Civil Miscellaneous Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed.
