The petitioners, who are respondents in the appeal have filed this application seeking appointment of an Advocate Commissioner to inspect the suit properties, contending that the appellant is attempting to alter the physical feature of the property, by carrying on extensive repair works employing several workmen. The respondent herein namely, the appellant in the above appeal has filed his counter wherein he has stated as follows: " 6. ...... I stoutly deny the allegations as false and vexatious. I had only fixed the camera as per the paper report dated 04.08.2016 for safety purposes. I state that the physical features of the building has not been altered or changed by me at any point of time..... ".

In view of the above, I do not find any need for appointment of an Advocate Commissioner. The above statement made by the respondent

in paragraph-6 of his counter affidavit is recorded and the petition is dismissed.
