ORDER

The petitioner, who was arrested and remanded to judicial custody on 29.01.2026 for the offences punishable under Sections 123 of BNS in Crime No.22 of 2026, registered on the file of the respondent police, seeks bail. 1/4

2. The case of the prosecution is that the petitioner along with other accused were found in possession of 52 nos of tapentadol hydrochloride tablets which is used for the purpose of intoxication. It is alleged that the petitioner compelled the victim to consume the banned drugs. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner is in judicial custody from 29.01.2026 and ready to co-operate with the investigation and prays to grant bail.

4. The learned Government Advocate reiterated the prosecution case and submitted that there are 4 previous cases pending against the petitioner which are similar in nature. Hence he opposed to grant bail.

5. I have gone through the F.I.R and other connected records which reveals that the petitioner has compelled the victim to consume the tapentadol hydrochloride tablets which is a Schedule-H drug under Drugs and Cosmetics Act.

6. Considering the submissions made by the learned counsel appearing on either side and the previous antecedents of the petitioner, if he is released on bail, he will indulge in similar type of offence. Hence, this Court is not inclined to grant bail to the petitioner.
