O R D E R
The petitioner lodged a complaint to the Police and thereafter, filed Crl.O.P.No.28735 of 2017 for a direction to the Police to register an FIR on his complaint. This Court, by order dated 21.12.2017 directed the Police to enquire into the complaint and take action in accordance with law. Pursuant to the said direction, the Police have registered a case in Crime No.153 of 2018 on 18.02.2018 under Section 409 and 420 IPC and investigation is in progress. Not satisfied with the progress of investigation, the petitioner is before this Court with the above prayer.
2.Heard Mr.Ramajayam, learned counsel for the petitioner and the learned Government Advocate.
3.It is the allegation of the petitioner that the accused has misappropriated the Panchayat funds that was allocated for green house scheme. The complaint does not even disclose the amount of embezzlement, nor the manner of misappropriation. 4.Taking into consideration the nature of the allegations in the complaint, this Court is of the view that this is not a fit case to transfer the investigation to the CBCID. However, this Court directs the Deputy Superintendent of Police, incharge of Thiruvenainallur Police Station to monitor the investigation that is being conducted by the Inspector of Police, Tiruvennainallur in Tiruvennainallur PS Crime No.153 of 2018 and expeditously complete the same and either file a Closure Report or a Charge Sheet as the case may be, under due intimation to the de facto complainant.
