ORDER
The writ petition has been filed seeking a mandamus to the respondents to consider the petitioner's representation dated 30.09.2024 for cancellation of legal heirship certificate dated 21,08.2024
2. The case of the petitioner is that she was married to one Munusamy and out of the wedlock six children namely Murugamma, Kanthamma, Jothiamma, Dhanalakshmi, Venkatesan and Rani, were born to them. The petitioner's husband Munusamy had died on 01.03.2024 leaving behind the petitioner and their children as his surviving legal heirs. The petitioner had applied for legal heirship certificate and death certificate of deceased Munusamy. To her shock and surprise, in the legalheir ship certificate issued by the authorities on 21.08.2024, one Swamymoorthy and his mother Chennammal, (whose name is also similar to the name of the petitioner) were included, however, the petitioner's name was omitted to be included. Therefore, the petitioner had submitted a representation dated 30.09.2024 to the Sub Collector, Hosur seeking to remove the names of Swamymoorthy and his mother Chennammal and to include her name in the legal heirship certificate of deceased Munusamy. Thereafter, the 2nd respondent had summoned Swamymoorthy and the petitioner herein, and during enquiry, Swamymoorthy
claimed that his mother Chennammal is the first wife of the deceased Munusamy. This was objected to by the petitioner and she had stated that she is the only wife of deceased Munusamy and had produced the necessary documents to substantiate her statement. Since the 2nd respondent could not arrive at a conclusion on the above issue, he had addressed a correspondence to the 3rd respondent on 24.10.2025, directing him to conduct an enquiry and submit a report. Thereafter, they were summoned and enquiry was conducted, however no orders were passed till date. Hence, the petitioner is before this Court.
3. This Court suo motu impleads the Sub Collector, Hosur as 4th respondent in the present writ petition.
4. Heard Mr.R.Poornima, learned counsel for the petitioner and Mr.R.Neelakandan, learned Additional Advocate General assisted by Mr.Yogesh Kannadasan, Special Government Pleader for respondents 1 to 4..
5. It is seen that the fourth respondent who has now been impleaded has directed the Tahsildar, Soolagiri, Krishnagiri District, the 3rd respondent, to conduct a field enquiry and submit a report. Since there has been no further action on the side of the 4th respondent, the petitioner has come forward with the present writ petition.
6. Considering the fact that the 4th respondent had directed the 3rd respondent to conduct a field enquiry with respect to the petitioner's claim as early as on 24.10.2025, and to submit a report, and since there appears to be no further development, this Court, without going into the merits of the case, directs the 3rd respondent to conclude the enquiry within a period of two weeks and submit a report to the Sub Collector, Hosur, and the 4th respondent shall thereafter pass orders within a period of four weeks, after affording an opportunity of hearing to the petitioner and other interested parties.
7. With the above directions, the writ petition is disposed of. No costs. 26-02-2026 Index: Yes/No Speaking/Non-speaking order DS
