PRAYER: Civil Revision Petition filed under Article 227 of Constitution of India, praying to direct the XVI Family Court, Villupuram at Villupuram District to dispose of the case in O.P.No.121 of 2023. For Petitioner : Mr.D.Vijay

ORDER

The Civil Revision petition is filed seeking earlier disposal of OP.No.121 of 2023 on the file of the XVI Family Court, Villupuram.

2. The petitioner herein filed a petition seeking desolution of the marriage solemnized between petitioner and respondent on 24.08.2022. The 1/4

petition was filed on 01.02.2023 and the same appeared to have been taken on file only during August 2023 and thereafter, the matter has been adjourned from time to time for filing counter. Aggrieved by the delay on the part of the respondent in filing counter, the petitioner has come by way of this revision seeking direction to the Family Court to dispose of the divorce petition at the earliest date.

3. In view of the fact that the counter in the main original petition is not filed, this Court is not inclined to entertain the civil revision petition at this stage. Further, as per the law declared by the Hon'ble Apex Court in the case of High Court Bar Association, Allahabad Vs State of Uttar Pradesh reported in 2024 INSC 150, the Constitutional Courts can fix time for disposal of cases pending before other Courts only in exceptional circumstances. The petitioner has not made out any exceptional circumstance for such direction. Therefore, the Civil Revision Petition is dismissed for the present. No costs.
