ORDER
This writ petition has been filed to forbear the respondents 3 and 4 from implementing the order, dated 11.05.2023 passed by the 3rd respondent, till the disposal of the revision petition, dated 06.06.2023, pending on the file of the 2nd respondent.
2. Mr.S.Arumugam, learned Government Advocate, accepts notice on behalf of the respondents 1 to 4. Since no adverse order is passed against the 5th respondent in this writ petition, notice to the 5th respondent is dispensed with by this Court.
3. Admittedly, aggrieved by the order, dated 11.05.2023 passed by the 3rd respondent, reducing the extent of land of the petitioners' property, the petitioners have preferred a revision petition, dated 06.06.2023 on the file of the 2nd respondent, which is still pending. Therefore, the question of forbearing the respondents 3 and 4 from implementing the order, dated Page No.2 of 7
11.05.2023 at this stage, that too, in the year 2026 after the order was passed on 11.05.2023 itself, does not arise. A direction was also issued by this Court in a writ petition filed by the respondents 3 and 4 to the official respondents to implement the order, dated 11.05.2023. In view of the same, the question of forbearing the respondents 3 and 4 not to implement the order, dated 11.05.2023, does not arise. If aggrieved by the order passed by this Court in the other writ petition filed by the respondents 3 and 4 directing the official respondents to implement the order, dated 11.05.2023, the petitioners ought to have filed a writ appeal. Having not filed the same, the question of forbearing the respondents 3 and 4 from implementing the order, dated 11.05.2023, does not arise.
The only limited relief that can be granted to the petitioners is to direct the 2nd respondent to dispose of the petitioners' revision petition, dated 06.06.2023, within a time frame to be fixed by this Court, after hearing the objections of the 5th respondent and by adhering to the principles of natural justice.
4. For the foregoing reasons, this Writ Petition is disposed of by directing the 2nd respondent to pass final orders on merits and in Page No.3 of 7
accordance with law on the petitioners' revision petition, dated 06.06.2023, after giving due consideration to the supporting documents filed by the petitioners and after hearing the objections of the 5th respondent, within a period of eight (8) weeks from the date of receipt of a copy of this order, by adhering to the principles of natural justice. No costs.
